COPPA Notice โ€” Please Read Before Creating Child Accounts

YourChores is subject to the Children's Online Privacy Protection Act (COPPA) and the FTC's 2025 amendments thereto. All child account creation requires verifiable parental consent recorded by the parent or legal guardian. Children do not provide personal information directly. Section 6 covers our COPPA compliance procedures in detail.

1. Acceptance of Terms

By accessing or using YourChores ("Service," "Platform," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms constitute a legally binding agreement. By creating an account, checking the acceptance boxes during registration, or using the Service after being notified of changes, you confirm you have read, understood, and agreed to these Terms.

Parents creating child accounts additionally agree to the Parental Consent terms in Sections 6 and 7. Your acceptance of those terms on behalf of your child is recorded in our compliance database as a separate, immutable legal record.

2. Description of Service

YourChores is a family productivity platform that allows parents to:

The Service is provided as-is. Features may change over time. We reserve the right to add, modify, or remove features with reasonable notice.

3. Account Registration

You must be at least 18 years old to create a parent account. You represent that all information you provide is accurate and complete.

You are responsible for maintaining the security of your credentials. Notify us immediately at security@yourchores.app if you suspect unauthorized access.

4. Parent Accounts

Parent accounts are the primary administrative accounts. The registered parent is responsible for all activity conducted through their account and all child accounts linked to it.

Parents may configure a Family Switcher PIN to restrict child access to parent dashboard features. We recommend all parents set a Switcher PIN.

5. Child Accounts โ€” General

Child profiles are created and managed by parent accounts. Children do not independently register for accounts. Children access their chore dashboards via:

Parent accounts maintain permanent oversight of all child account activity. Parents may view, modify, or delete any child account data at any time.

Our Compliance Architecture

YourChores is designed from the ground up to comply with COPPA (15 U.S.C. ยง 6501 et seq.) and the FTC's 2025 final rule amendments. Child personal information is never solicited directly from children. All child account data flows exclusively through parent-controlled channels.

6.1 Who COPPA Applies To

COPPA applies to the online collection of personal information from children under 13. YourChores applies its COPPA protections to all child accounts regardless of age as a matter of policy.

6.2 The Parental Consent Record

Before any child account is created, the parent or legal guardian must complete a Parental Consent Form that records:

This record is stored immutably in a separate database table. Consent records are never deleted, even if the child account is deleted. They are retained for a minimum of 7 years for regulatory compliance purposes.

6.3 What the Parent Attests

By submitting the consent form, the parent legally attests that:

False attestation may constitute fraud and is subject to applicable state and federal law.

6.4 Operator vs. Third-Party Distinction

All data associated with child accounts remains exclusively within YourChores systems. No child personal information is disclosed to any third party. Internal analytics divisions operating under the same legal entity are not "third parties" under COPPA and do not constitute a disclosure triggering additional consent requirements, provided such analytics do not include personal information as defined under 16 C.F.R. ยง 312.2.

Key legal principle: Because parents โ€” not children โ€” enter all personal information associated with child accounts, the COPPA prohibition on collecting personal information "from children" is not triggered for email addresses. The parent is the data subject acting on behalf of the child. This consent architecture is documented, timestamped, and auditable.

7. Email Addresses for Child Accounts โ€” Parent-Provided

The inclusion of an email address on a child's account is entirely optional. When provided, the following applies:

7.1 Who Enters the Email

The email address is entered by the parent through the parent-authenticated Add Child form. It is not collected from the child directly. The child is never prompted to enter an email address. The system architecture prevents any email collection pathway that bypasses the parent consent flow.

7.2 Purpose of the Child's Email

The child's email is used exclusively for:

7.3 Parent Consent Recorded

Every child email address addition creates a separate consent record in our Parental Consent database, capturing the parent's explicit acknowledgment that they โ€” not the child โ€” are providing the email. This record includes the exact consent language shown, the timestamp, and the parent's identity information.

7.4 Data Minimization

In accordance with COPPA's 2025 data minimization requirements, we collect only what is necessary to provide the login functionality. We do not associate the child's email with behavioral data, analytics, or research pipelines. The email field is stored separately from behavioral event records.

Note: Parental consent records themselves are retained per Section 6.2 as a legal compliance requirement regardless of account deletion.

12. Limitation of Liability โ€” COPPA and Parental Consent

12.1 Parent-Initiated Data Entry. The parent or legal guardian is solely responsible for the accuracy of all information entered during the child account creation process, including but not limited to the child's email address, display name, age group, and parental identity information. YourChores is not liable for any consequences arising from inaccurate, false, or unauthorized information provided by the registering adult.

12.2 Parental Attestation Liability Shield. YourChores has designed its child account creation process to comply with COPPA by requiring verifiable parental consent before any child personal information is collected. Because all child personal information is entered by the parent under a legally recorded attestation, YourChores is not the proximate collector of that information from the child. To the maximum extent permitted by applicable law, YourChores disclaims liability for COPPA claims arising from information voluntarily provided by an attesting parent where: (a) the consent form was presented in full; (b) the parent affirmatively checked all required consent boxes; (c) a consent record was generated and stored; and (d) the platform architecture prevented direct data collection from the child.

12.3 No Liability for Third-Party Breaches of Child Email. Once an activation email is delivered to an address provided by the parent, YourChores is not liable for any access to that email account by the child or any third party. The parent is responsible for ensuring the child's email account is appropriately secured and supervised.

12.4 General Limitation. To the maximum extent permitted by law, YourChores's total liability to any parent or user for claims relating to child accounts shall not exceed the greater of (a) the total fees paid by the parent to YourChores in the 12 months preceding the claim, or (b) $50 USD. YourChores shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

12.5 Indemnification by Parent. You agree to indemnify and hold harmless YourChores, its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses (including attorneys' fees) arising from: (a) your provision of false or inaccurate information during the parental consent process; (b) your failure to properly supervise your child's use of the Service; or (c) your violation of these Terms.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. YOURCHORES DISCLAIMS ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free from viruses or other harmful components.

14. Indemnification

You agree to defend, indemnify, and hold harmless YourChores from any claims arising from your use of the Service, your violation of these Terms, or your violation of any rights of another person or entity.

15. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law provisions. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.

16. Changes to Terms

We may update these Terms from time to time. We will notify registered parents by email at least 30 days before material changes take effect. Continued use after the effective date constitutes acceptance. The current version number and effective date are displayed at the top of this page.

When Terms are updated, existing child account consent records are retained and linked to the version in effect at the time of consent. New consent may be required for material changes affecting child data practices.
